Park Shadows HOA Acceptable Use Agreement
Please note that the access to the parkshadowshomeowners.com website must be for the
purpose of learning about the Park Shadows HOA community or contributing to it. Any contributions to the
website must be in accordance with the civility that all members of the community are expected to afford one
another. Users are legally responsible for their own statements. Park Shadows HOA assumes no responsibility
for the posts/contributions of users. Users are responsible for ensuring that their posts/contributions are
legal in every respect and do not infringe on the rights of others. Access may be logged. Users who violate
this agreement may have their access restricted or removed.
Park Shadows HOA has no obligation to provide any maintenance or support for any level of service with
respect the to the website, nor does Park Shadows HOA make any representation, express or implied, with
regard to the quality and operability of the website or website content.
Confidentiality. The user agrees to protect and safeguard the confidentiality of all Confidential
Information with at least the same degree of care as it would protect the user’s own confidential
information, but in no event with no less than a reasonable degree of care. The user agrees not to use
Confidential Information in any manner to Park Shadows HOA's or any other user's detriment, including
without limitation, to reverse engineer, disassemble, decompile or design around the same and further agrees
not to disclose, or distribute, or publish, or copy, or reproduce, or sell, or lend, or manipulate, or
otherwise make use of Confidential Information, except with the express authorization of all concerned
parties.
Intellectual Property. By submitting postings or other contributions, users grant Park Shadows HOA, our
subsidiaries, affiliates, successors, and assigns a perpetual, irrevocable, worldwide, royalty-free,
fully-paid, non-exclusive, and sub-licensable license to use, copy, display, distribute, modify, adapt,
publish, translate, publicly perform and publicly display the postings/contributions (in whole or in part)
and to incorporate the postings/contributions into other works in any format or medium now or later known,
and to sublicense such rights through multiple tiers of sublicenses.
This Agreement does not constitute and shall not be construed as constituting a partnership or joint venture
between the parties or as making either party an employee, agent or representative of the other.
This Agreement may not be assigned, modified, or transferred by the user. Park Shadows HOA may modify this
agreement or the website at any time of its choosing. Park Shadows HOA may grant or restrict access as it
deems necessary. All elements of this agreement, any policies therein, express or implied, and operation of
the website shall be subject to the interpretation of Park Shadows HOA.
If any provision of this Agreement is held to be or becomes invalid, illegal or unenforceable, such
provision or provisions shall be reformed to be as nearly possible to the intent of the parties and the
remainder of the Agreement shall not be affected and shall remain valid and enforceable to the greatest
extent permitted by law.
